Terms of Service

1. What HostTalk Is

HostTalk is a technology platform that provides AI-powered voice assistant services for vacation rental property managers. It enables inbound guest calls to be answered automatically using artificial intelligence configured with your property-specific information.

HostTalk is not:

• An emergency response service
• A professional advice service (legal, safety, medical, or financial)
• A human answering service or staffing agency
• A party to any agreement between property managers and their guests

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding contract. By using HostTalk, you represent that you meet these requirements and that you will use the platform only for lawful purposes in compliance with all applicable laws.

3. Account Registration

You agree to provide accurate, current, and complete information when creating your account and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@hostalk.app if you suspect unauthorized access.

4. Property Manager Responsibilities

As a property manager using HostTalk, you are solely responsible for:

• The accuracy, completeness, and legality of all property information you enter into the platform
• Ensuring your use of HostTalk complies with all applicable local, provincial, state, and federal laws including short-term rental regulations
• Compliance with call recording consent laws applicable to your property's location
• Ensuring guests have access to emergency contact information and are not solely reliant on HostTalk for urgent matters
• Any representations made to guests through HostTalk's AI based on your configured property knowledge base

5. AI Service Limitations

HostTalk's AI assistant:

• Responds only based on the property information you configure — it does not browse the internet or access external data
• May make errors, omissions, or produce unexpected responses
• Is not a substitute for human judgment in complex, sensitive, or emergency situations
• Does not guarantee any particular guest experience outcome or review result

Albor Digital LLC is not liable for AI responses that are inaccurate or incomplete where such inaccuracies result from incomplete or incorrect property information provided by the property manager.

6. Subscription, Billing, and Cancellation

Plans and Pricing

HostTalk offers monthly and annual subscription plans as described at hostalk.app/pricing. Prices are in USD.

Free Trial

New accounts receive a 14-day free trial with up to 25 AI-handled calls. No credit card is required to start. At the end of the trial, a paid subscription is required to continue.

Billing

Subscriptions are billed at the start of each billing period. Payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method for the applicable fee.

Overage

If you exceed your plan's included call limit, additional calls are billed at $0.30 per call at the end of your billing period.

Cancellation

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.

Refunds

We do not offer refunds on paid subscription fees except where required by applicable law.

7. Acceptable Use

You agree not to use HostTalk to:

• Collect sensitive personal information from callers such as payment card numbers, government IDs, or passwords
• Deceive callers about the AI nature of the service when sincerely asked
• Conduct outbound calling, telemarketing, or robocalling campaigns
• Facilitate or enable illegal short-term rental activity
• Circumvent, overload, reverse-engineer, or abuse the platform infrastructure
• Harass, threaten, or surveil any individual
• Violate any applicable law or regulation

Violations may result in immediate account suspension or termination without refund.

8. Intellectual Property

All HostTalk platform code, design, branding, and documentation is owned by Albor Digital LLC and protected by applicable intellectual property laws. You retain ownership of your property data and call content. By using HostTalk, you grant us a limited, non-exclusive license to process your data solely to deliver the service.

You agree to indemnify, defend, and hold harmless Albor Digital LLC and its officers, directors, and employees from any claims, damages, or expenses including legal fees arising from your use of HostTalk, your property information, your violation of these Terms, or your violation of any applicable law.

12. Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or if required by law. You may terminate your account at any time by cancelling your subscription and contacting support@hostalk.app. Upon termination, your property data and call records will be deleted within 30 days, except where retention is required by law.

13. Dispute Resolution

Informal Resolution

Before filing any legal claim, contact us at legal@hostalk.app and attempt to resolve the dispute informally for at least 30 days.

Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles.

Arbitration

Any dispute not resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English. You agree to bring claims only in your individual capacity, not as a plaintiff or class member in any class action.

14. Changes to These Terms

We may update these Terms at any time. We will notify you by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
